拟设立省级自然保护区的，由拟设立的自然保护区所在地设区的市、县级人民政府提出申请，由省、自治区、直辖市人民政府林业草原主管部门会同有关部门组织评审后，提出审批建议，报省、自治区、直辖市人民政府批准，并抄送国务院林业草原主管部门和有关部门。
